Benny's Dog Resort Doggie Hotel and Daycare Contract

** All dogs must be spayed or neutered and show proof of vaccinations for: Rabies, Bordetella (Kennel cough), Distemper, Hepatitis, Leptospirosis, Parvovirus and Parainfluenza (DHLPP+C)
** Please bring your dog's own food. Inform us of any medications or behavior issues (chewing, pees/poops indoors, scared of storms, etc.

As the legal owner of the above-mentioned pet(s), having carefully read and understand this agreement, do hereby grant Benny's Dog Resort, Inc., Benny de la Vega, permission to take any and all action necessary to secure the well being and health of the above mentioned pet(s) including any medical attention deemed necessary. I agree to reimburse Benny's Dog Resort, Inc. for any expenses incurred in securing the well being and health of my pet(s). I agree to reimburse Benny's Dog Resort, Inc. for any property damage caused by my dog during day-care or boarding. Benny's Dog Resort, Inc. agrees to exercise due and reasonable care, and to keep the premises sanitary and properly enclosed. The dog(s) is (are) to be fed properly and regularly, and to be housed in clean, safe quarters. All dogs are boarded or are otherwise handled or cared for by Kennel staff without liability on Kennel's part for loss or damage from disease, theft, fire, death, escape, injury or harm to persons, other dogs or property by said dog(s), or for other unavoidable causes, due diligence and care having been exercised. Owner fully understands the risks when dogs play, "rough house" and socialize with one another; that a bite, scratch, cut or fight can result during normal activity. Owner understands that accidents can and do happen (i.e. dogs scratch themselves, sudden movements when being groomed, running up and down stairs, etc.) Owner understands and agrees that dog(s) picked up after 7:00 P.M. shall be charged for an additional full night's stay. All charges incurred by Owner shall be payable upon pickup of pet(s). Owner further agrees that pet(s) shall not leave the Kennel until all charges are paid to Kennel by Owner. Kennel shall have, and is hereby granted, a lien on the pet(s) for any and all unpaid charges resulting from boarding pet(s) at Kennel. If the pet(s) becomes ill or if the state of the animal's health otherwise requires professional attention, Kennel, in its sole discretion, may engage the services of a veterinarian of its choosing, or administer medicine, or give other requisite attention to the animal, and the expenses thereof shall be paid by Owner. As lawful consideration for my pet being permitted by Benny's Dog Resort, Inc. to participate in activities and to use Benny's Dog Resort, Inc. facilities, I hereby agree that I, my heirs, guardians, legal representatives, and assigns will not make a claim against, sue, attach the property of, or prosecute Benny's Dog Resort, Inc., its shareholders, directors, owners, employees or its assigns for injury, loss, damage from disease, death, running away, theft, fire, injury to persons, injury from other pets, to my pet resulting from negligence or other acts, however caused, by any employee, agent, shareholder or contractor of Benny's Dog Resort, Inc., or its assigns, as the result of my pet's participation in activities.

IN ADDITION, I HEREBY RELEASE AND DISCHARGE BENNY'S DOG RESORT, INC., ITS OFFICERS, DIRECTORS, OWNERS, EMPLOYEES OR ITS ASSIGNS FROM ALL ACTIONS, CLAIMS, OR DEMANDS THAT I, MY HEIRS, GUARDIANS, LEGAL REPRESENTATIVES, OR ASSIGNS NOW HAVE OR MAY IN THE FUTURE HAVE FOR INJURY, LOSS, DAMAGE FROM DISEASE, DEATH, RUNNING AWAY, THEFT, FIRE, INJURY TO PERSONS, INJURY FROM OTHER PETS, TO MY PET RESULTING FROM MY PET'S ACTIVITIES AT BENNY'S DOG RESORT, INC. WHETHER OR NOT RESULTING FROM THE NEGLIGENCE, GROSS NEGLIGENCE OR MISCONDUCT OF ANY PERSON, OR THE ACTIONS OF ANOTHER ANIMAL. IN ANY EVENT, THE PET OWNER AND BENNY'S DOG RESORT, INC. AGREE THAT BENNY'S DOG RESORT'S LIABILITY SHALL NOT EXCEED THE SUM OF $200.00 PER ANIMAL. I also agree to indemnify and hold harmless Benny's Dog Resort, Inc., its officers, directors, owners, employees and/or its assigns, from any and all claims due to any damage the pet may cause to any person or other animal while on the Benny's Dog Resort, Inc. premises. In the event Benny's Dog Resort, Inc., deems it necessary to employ legal counsel to protect their rights under this agreement, the owner/agent of the pet agrees to pay all expenses incurred by Benny's Dog Resort, Inc., to enforce their rights under this agreement including but not limited to costs and reasonable attorneys fees. I understand that Benny's Dog Resort, Inc. reserves the right to deny admittance, and/or remove from the premises, or segregate any pet at their discretion. In the event that my pet needs to be removed from the premises, Benny's Dog Resort, Inc. will attempt to contact me at the numbers provided. In the event I cannot be reached or my emergency contact cannot be reached, Benny's Dog Resort, Inc. may proceed with removal of my pet to my authorized veterinarian. I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND BENNY'S DOG RESORT, INC. AND I HAVE SIGNED IT OF MY OWN FREE WILL. I am eighteen years of age or older. I understand the rate schedule and agree that all fees are due and payable when I drop-off or pick up my dog. I acknowledge that I have received and reviewed a copy of Benny's Dog Resort, Inc.'s policies and that I understand and agree to comply with all of them. Further, I acknowledge that all information I have disclosed to Benny's Dog Resort, Inc. is true and correct to the best of my knowledge. It is understood by Kennel and Owner that all provisions of this Contract shall be binding upon both parties for this visit and for all subsequent visits. This Contract contains the entire agreement between the parties.
